The ordinance is intended to update the City's public indecency code provision that was originally adopted in 1959 and to make it more consistent with provisions of the LMC relating to adult entertainment. The ordinance would also address issues relating to potential lewd or indecent conduct occurring in the public, including business establishments that may serve customers through a drive-up window or door.
This version of the ordinance has been revised to include a provision in the definition section dealing with a "public place provided or set aside for nudity" to address nudity in public places necessarily and customarily expected outside the home. The City Attorney will be prepared to address the questions and comments made at the October 5, 2009 work session
