TITLE: 2012 Hearing Examiner Report

SUMMARY:
Under the standing contract the Hearing Examiner is required to provide the Council with an annual report reviewing the cases decided during the year.  It is also used by the Examiner to raise issues or concerns over existing codes, policies and procedures.

2012 was a particularly slow year for Examiner activity.  The only action was a dispute over a decision concerning the expiration of a Building Permit for Surineder Rekhi.  The Examiner decided in favor of the City.  The case was then appealed to court where the case was again decided in favor of the City and ultimately dropped.

In the future Examiner activity is likely to increase for two reasons.  Increasing development activity will result in higher case loads.  In addition to City Council made significant changes to  approval procedures where the Examiner rather than the Council will make final decisions on many actions.  As a reminder, the Examiner's decisions are based upon ordinances, policies and plans adopted by the City Council.

Staff will endeavor to set up a process for transmitting the Examiner's decisions to  the Council add to your ability to staff informed.

The Examiner's contract is funded from an expenditure established in our annual Budget.  There is a level of cost recovery for some actions, for example appeals of staff decisions, that have established fees.
